Title:
La successione delle figlie nel feudo: il feudo materno e l'opinio Baldi
Source:
VI Centenario della morte di Baldo degli Ubaldi 1400-2000. Edited by Carla Frova, Maria Graza Nico Ottaviani, and Stefania Zucchini. Universita degli studi, 2005. Pages 263 - 288.
Description:
Medieval jurists disputed the ability of women to inherit or transmit claims to fiefs. Some were unwilling to deprive women of the right to inherit, although they were unable to bear arms. Baldus de Ubaldis stated three cases in which a woman's rights trumped those of more distant male kin, although not of sons or brothers: a new investiture by an overlord; direct inheritance in the absence of nearer male heirs; a grant by an overlord directly to her. Description supplied by Feminae.
