  • Description: Medieval jurists disputed the ability of women to inherit or transmit claims to fiefs. Some were unwilling to deprive women of the right to inherit, although they were unable to bear arms. Baldus de Ubaldis stated three cases in which a woman's rights trumped those of more distant male kin, although not of sons or brothers: a new investiture by an overlord; direct inheritance in the absence of nearer male heirs; a grant by an overlord directly to her.
