Description:
The Second Lateran Council issued a canon annulling the marriages entered into by higher clergy (subdeacons, deacons and priests). This canon went beyond enforcing celibacy to abandoning an older acceptance that these marriages were legitimate. The
Decretum
of Gratian included the Lateran text but did not make it grounds for a formal impediment annulling an attempted marriage. The canonists gradually develop this impediment, which was included in the
Gregorian Decretals
of 1234. The Lateran canon by then had dropped out of the discussion, only to be revived in the codification of canon law in 1917.
