Neither Slave nor Free: Theology and Law in Gratian's Thoughts on the Definition of Marriage and Unfree Persons [The original text of Gratian's "Decretum" favored the right of unfree persons to marry, even when the other partner was ignorant of a spouse's servile status. The vulgate version of the text inserted older canons requiring a master's consent to the marriage. The canonists eventually adopted Gratian's opinion. Title note supplied by Feminae.]
